2. Data processing of persons in the business environment

Data processing according to Art. 13 GDPR

We process the data that various persons provide to us through their own statements, for example in the context of an enquiry by e-mail, for the purpose of initiating and concluding a contract or a business relationship.

Data processing according to Art. 14 GDPR

In addition, we process data of persons who may be part of a contractual relationship, which we have permissibly received in the context of information provided by third parties (event organizers provide us with the names of participants, companies provide us with data of their employees).

Data Subjects

We process the following data of customers, members and guests of events – if necessary: Title, name of customer, name of contact person for corporate customers, date of birth, e-mail address, address, payment data.
We process the following data from suppliers and third-party organizers: Company, title and names of contact persons, professional address data and contact data, bank details, contract data.
We process the names and image data of artists.

Disclosure of Data

Personal data will only be passed on to third parties if this is necessary for the purpose of processing and fulfilling the contract or if it is required by law.

Retention/Deletion of Data

Data will be deleted by us as soon as storage is no longer necessary/permitted or legal, e.g. statutory, retention obligations have expired. If the basis of the processing is consent, we restrict the processing or delete the data when the consent is revoked – unless there are legal regulations to the contrary.

Contacting us by e-mail for information purposes

When you contact us by e-mail, the data you provide will be stored by us in order to answer your questions. We delete the data accruing in this context after the processing is no longer necessary or restrict the processing if there are statutory retention obligations.

Publication of Authors’ Names

We are required by law to disclose names of creators of image data (photos or videos) whenever we publish image data. We delete this personal data automatically as soon as we stop using the image data or on the basis of a deletion request from a data subject.

Legal Basis

The legal basis for data processing is

  • the initiation and fulfillment of the contract in accordance with. Kind. 6 para. 1 lit. b GDPR (such as ticket sales).
  • legal obligations acc. Kind. 6 para. 1 lit. c GDPR, (e.g. legally prescribed storage and documentation obligations, publication obligations under copyright law).
  • legitimate interests of our company within the meaning of Art. 6 para. 1 lit. f GDPR (e.g. use of software, answering emails)
  • Kind. 6 para. 1 lit. a GDPR when obtaining consent (e.g. when processing image data or for advertising purposes).

3. Data processing in the context of ticket sales

Ticket sales when contacting us by telephone or e-mail

If you order tickets from us by phone or e-mail, we process the following data for the purpose of fulfilling the contract: name, e-mail address, address data and payment data.

Ticket sales via the ticket shop

If you buy tickets for events and guided tours via the ticket shop, we process the following data: name, date of birth, address, telephone number, e-mail address, payment data, contract data. Legal basis: Art. 6 para. 1 lit. b GDPR

4. Contact form for special tours

On our website, you have the option of bindingly registering for a special guided tour via a web form. To do this, we need your name, address and e-mail address. You can also voluntarily provide us with your telephone number. We process your data for the registration, implementation and billing of the booked event. The data will be deleted by us when legal storage obligations have expired.
We use Google Forms to register for special tours. We have entered into a contract with Google Ireland Limited (“Google”), a company incorporated and operated under the laws of Ireland (registration number: 368047) with its registered office at Gordon House, Barrow Street, Dublin 4, Ireland. Nevertheless, it is possible that data may be transferred from Europe to the USA, although we as a company have no influence on this.

Data Processing in the USA

It cannot be ruled out that personal data will be transferred to the USA through the use of our form.
The GDPR sets so-called appropriate safeguards for a transfer of data to a third country or to an international organization in accordance with Art. 46 GDPR. These are not available for the United States.
Possible risks that cannot currently be excluded for you as a data subject in connection with the aforementioned information are in particular:

  • Your personal data could possibly be passed on to other third parties (e.g.: US authorities) by the respective service provider beyond the actual purpose of fulfilling the order.
  • You may not be able to sustainably assert or enforce your rights of access against the respective service provider.
  • There may be a higher probability that incorrect data processing may occur because the technical organizational measures for the protection of personal data do not fully comply with the requirements of the GDPR in terms of quantity and quality.

With your consent to the processing of data via Google Forms, you explicitly consent to the transfer of data to the USA.

5. Newsletter & information about future offers

You have the option of subscribing to our newsletter. For this purpose, we need at least your first and last name as well as your e-mail address. You are welcome to provide us with further data voluntarily, such as gender, title, company, industry, department, number of employees, address, telephone number. You can cancel your subscription to the newsletter at any time. Once you have unsubscribed, we will no longer use your data for sending the newsletter. If we do not have any business relationship with you and are not subject to any legal retention obligations, your data will be deleted after you have unsubscribed from the newsletter.

If we have received your contact details in connection with the purchase of a ticket, we will inform you of similar offers.
For this purpose, we process your name, your postal address, your ticket purchases and – within the framework of § 174 TKG – your e-mail address and do not pass this data on to third parties. You can always let us know if you do not want to receive information about similar offers.

6. Data processing when visiting our website

Informational use of the website

In the case of merely informative use of the website, we only collect the personal data that your browser transmits to our server (server log files). If you wish to view our website, the most data we collect is that which is technically necessary for us to display our website to you and to ensure its stability and security:

  • IP address
  • Date and time of the request
  • Time zone difference to Coordinated Universal Time (UTC)
  • Content of the request (specific page)
  • Access status/HTTP status code
  • Website from which the request came

  • Operating system and its interface
  • Language and version of the browser software.

This data will not be merged with personal data sources. We reserve the right to check this data retrospectively if we become aware of concrete indications of illegal use, and to pass on the data to the law enforcement authorities if there has been a hacking attack. When you use our website, cookies are stored on your computer. Cookies are small text files that are stored on your hard drive in relation to the browser you are using and which provide the party setting the cookie (in this case, us or third-party providers) with certain information. Cookies cannot execute programs or transmit viruses to your computer.
The cookie allows you to be recognized when you visit the website without having to re-enter data that you have already entered previously.
The information contained in the cookies is used, for example, to determine whether you are logged in or which data you have already entered, or to recognize you as a user when a connection is established between our web server and your browser.

Google Gstatic

We use Google Gstatic on our website. Gstatic is a domain used by Google to load static content into another domain name in order to reduce bandwidth usage and increase network performance for the end user. By consenting to the processing of (advertising and marketing) cookies, you explicitly consent to the transfer of data to the USA. You can remove cookies stored on your PC yourself at any time by deleting the temporary internet files.

7. Social media presence

We operate the following social media pages: YouTube, Facebook, Instagram. When visiting our social media presence, personal data, including the IP address, is processed by the respective provider and cookies are used for data collection. Please refer to the privacy policy of the respective service to find out exactly what information is transmitted. There you will also find information about contact options as well as for various settings. We focus on comprehensive customer satisfaction and use these services primarily to be able to get in touch or to communicate with you. Furthermore, we see it as an additional possibility to our other existing information offers.
In the case of services with a US connection, the data collected is usually sent to a server in the USA and stored there. We have no influence or control over the type and scope of the data processed by these services, the type of processing and use or the transfer of this data to third parties. For options to restrict the processing of this data in the respective settings of these services, please refer to the detailed descriptions of the data protection declarations of the respective providers.

Furthermore, we point out that you use the respective services and their functions on your own responsibility. This applies in particular to the use of the interactive functions (for example sharing, commenting or rating).
The providers of the social media services have provided us with corresponding agreements – in most cases these are agreements on joint responsibility for data processing. The use of social media is based on our legitimate, operational interest.
